Minutes:

Councillor Peake made a declaration of interest in respect of application S/10/1187 as he had previously considered the application with Highworth Parish Council, and took no part in the voting thereon.

Exempt Items - Exclusion of Press and Public

Certain items are expected to include the consideration of exempt information and the Planning Committee is, therefore, recommended to resolve "That, in accordance with Section 100A(4) of the Local Government Act 1972, the public be excluded during the discussion of the matters referred to in the items listed below, on the grounds that they involve the likely disclosure of exempt information, as defined in the respective paragraph of Part 1 of Schedule 12A of the Act, and the public interest in maintaining the exemption outweighs the public interest in disclosing the information".

            Resolved – (1) That permission to develop be granted in respect of the following applications, subject to the conditions listed in the Committee Report, the Additional Information Sheet circulated before the meeting and the Further Late Papers circulated at the meeting:

            (2) That consideration of application numbered S/10/1340 be deferred pending a visit to the site by Planning Committee members.

 

            (3) That the Director of Planning and Transport be authorised to grant permission in respect of application numbered S/10/846 following the completion of a Legal Agreement and subject to the conditions listed in the Committee report, and any additional or amended conditions as may be appropriate.

 

(4) That the Director of Planning and Transport be authorised to grant permission in respect of application numbered  S/09/2318 subject to the conditions listed in the Committee report and any additional or amended conditions as may be appropriate and subject to the securing of developer contributions through a planning obligation. If by the 30th December 2010 the outstanding issues have not been satisfactorily resolved the application may be refused for the reasons set out in the report.

 

            (5) That the Director of Planning and Transport be authorised to grant permission in respect of application numbered S/09/2304 subject to the satisfactory completion of a deed of planning obligation to secure the appropriate developer and highway contributions and appropriate noise mitigation measures by 30th November 2010 and subject to the conditions set out in the Committee report and the Additional Information Sheet circulated before the meeting.

The Director of Planning and Transport submitted a report seeking approval for the Draft Victoria Road Local Development Order and accompanying documents to be made available for public consultation.

Resolved – (1) That the Director of Planning and Transport be authorised to make the Draft Local Development Order and accompanying documents available for public consultation for a period of six weeks as soon as is practicable;

       (2) That the Director of Planning and Transport be authorised to make minor drafting or typographical changes to the content of the document if required prior to public consultation;

       (3) That the results of the public consultation are reported to this Committee along with the final version of the Local Development Order, which will incorporate consultation issues as appropriate; and

       (4) That that the Director of Planning and Transport be authorised to carry out the steps detailed in paragraphs 3.1 to 3.2.of the report.

The Director of Law and Democratic Services submitted a report concerning the current position in relation to Planning Agreements authorised by this Committee or by officers under delegated powers, which need to be completed before planning permission can be issued.  The report also sets out details relating to Unilateral Planning Obligations (“Unilateral Undertakings”) accepted in lieu of Planning Agreements.   

Resolved – That the report be noted.
