            Resolved – (1) That permission to develop be granted in respect of application numbered S/10/1165, subject to the conditions listed in the Committee Report.

 

            (2) That permission be refused in respect of the following applications for the reasons set out in the Committee report.

 

S/10/1220, S/CAC/10/1226

 

            (3) That consideration of the following applications be deferred:

 

S/10/1392, S/10/1541, S/10/1542 and S/10/905

 

            (4) The Director of Planning and Transport be authorised to grantplanning permission in respect of application numbered S/10/921 subject to the Conditions set out in the Committee report and any additional or amended conditions as may be appropriate, and subject to the completion of a Section 106 legal agreement.

If the legal agreement is not completed by 22nd December 2010 and the material obligations that can be used to support the granting of planning permission have not been secured, including the detail of Affordable Housing, the Director of Planning and Transport be authorised to refuse the application for the reasons set out in the Committee report.

 

 (5) That the Director of Planning and Transport be authorised to grant permission in respect of application numbered S/10/1340 subject to the conditions listed in the Committee report and any additional or amended conditions as may be appropriate.

 

            (6) That the Director of Planning and Transport be authorised to grant planning permission in respect of application numbered S/10/898 subject to the conditions listed in the Committee report and to the completion of a S106 legal agreement to review the economic viability of the scheme post completion, the detail of which be delegated to officers to conclude.

In the event that the agreement is not completed by 22nd December 2010 then the Directorate of Planning and Transport be authorised to refuse the application for the reasons set out in the Committee report.

       (7) That the Director of Planning and Transport be authorised to grant planning permission in respect of application numbered S/10/396 subject to the conditions listed in the Committee report and subject to the delegated authority to conclude the detail of the drafting, and completion of a S106 legal agreement to secure a review of the viability of the development post completion (and the payment of a proportion of the infrastructure package agreed up to the maximum value in the event of economically viable profit margins being achieved).

On consideration of (a) a report of the Director of Planning and Transport concerning (i) an update of the Developer Contributions Development Control Guidance Note (“the adopted DCGN”) 2006 including:

-         The integration of contributions to Waste Management, and Wiltshire Fire & Rescue Service,

-         The use of updated evidence bases for the alteration of the methodologies for calculating the Leisure contribution and securing Education contributions; and

(ii) seeking approval for the update to be incorporated into the Council’s adopted DCGN; and

(b) The draft minutes of the Development Delivery Panel held in October 2010 and an email sent by Les Durrant (DPDS) to the Director of Planning and Transport titled “Swindon Development Delivery Panel – CIL Regulations and S.106 Agreements/Developer Contributions tabled at the meeting.

Resolved – That this Committee approves the Developer Contributions Guidance Note 2010 Update (“the DCGN Update 2010”); and accompanying evidence base updates to be used with immediate effect as the adopted Guidance on developer contributions to infrastructure;

The Director of Planning and Transport submitted a report seeking approval for the revised Validation Checklist Development Control Guidance Note.

Resolved - That this Committee:

        (1) Endorses the introduction of the revised Validation Checklist Development Control Guidance Note, as amended, as soon as it practicable; and

            (2) Authorises the Director of Planning and Transport to make minor drafting or typographical changes to the content of the document and lists if required

40.

Site Visits

Minutes:

Resolved – That, due to the extensive and detailed application information available at the Committee meeting, the Committee reaffirms its position not to undertake pre-arranged visits to the sites of individual applications and any interested party requesting a site visit be advised of this.

Individual Members of the Committee can, under their own volition and with the appropriate Planning Officer, visit a site if they consider it necessary.
