Minutes:

A member of the public asked why the Council did not have a policy to the effect that, if for example 10 objections were received in respect of a planning application then it should automatically be referred to Planning Committee.

Andy Brown replied that it is the nature and planning merit of an objection that is considered relevant, not the quantity received.

            Resolved – (1) That permission to develop be granted in respect of application numbered S/11/103, subject to the conditions listed in the Committee Report, the Additional Information Sheet circulated before the meeting and the Further Late Papers circulated at the meeting, as amended below, and subject to the following additional conditions, together with the removal of original condition 2.

 

Amended condition 1

1 The use hereby permitted shall be discontinued and the land restored to its former condition on or before 30th October 2012; in accordance with a scheme of work that shall have first been submitted to and approved in writing by the local planning authority.

Reason: To safeguard the amenities of the area and to monitor the approved use in terms of impact on parking and highway safety in the local area.
Relevant Policies: DS6 Swindon Borough Local Plan 2011 (2006).

Additional conditions

2 When the applicant Miss Lindsay Marcer ceases the use hereby permitted at the property (3 Caversham Close), the use hereby permitted shall cease and all materials and equipment brought onto the premises in connection with the use shall be removed and the land reinstated to its former condition (Class C3 Use) Dwellinghouse.

Reason: To safeguard the amenities of the area and to monitor the approved use in terms of impact on parking and highway safety in the local area.

Relevant Policies: DS6 Swindon Borough Local Plan 2011 (2006).

 

3 A scheme of noise insulation and or attenuation measures for the sound proofing of the grooming parlour shall be submitted to and approved in writing by the Local Planning Authority. The approved details shall be carried out prior to the commencement of the development hereby permitted unless otherwise agreed in writing by the Local Planning Authority and be permanently retained thereafter.

Reason: To safeguard the amenities of the nearby residents and to protect the general environment.

Relevant Policies: DS6 Swindon Borough Council Local Plan 2011 (2006)

 

            (2) That permission be refused in respect of application numbered S/TC/11/339 for the following reason.

 

The proposal by reason of its siting and proximity to residential properties, together with its height and appearance, will have an adverse impact on the character and appearance of the area within which it is located, to the detriment of visual amenity. On consideration of (a) a report of the Director of Planning and Transport seeking approval to publish the draft ‘Residential Extensions and Alterations Supplementary Planning Document (SPD)’ for public consultation, and (b) the comments of Councillor Greenhalgh

Resolved – That the draft ‘Residential Extensions and Alterations Supplementary Planning Document (SPD)’ be published for public consultation in accordance with the arrangements detailed in paragraphs 3.1-3.2.of the report.

On consideration of (a) a report of the Director of Planning and Transport concerning the outcomes of the public consultation exercise in respect of the draft ‘Inclusive Design Access For All Supplementary Planning Document’ (SPD) and seeking approval and adoption of the final ‘Inclusive Design Access for All Supplementary Planning Document’ (SPD) for the purposes of development management, and (b) the comments of Zena May of the Swindon Access Action Group.

Resolved - That this Committee:

            (1) Notes the representations made to the public consultation exercise and the consequent amendments to the SPD

            (2) Agrees to the approval and adoption of the ‘Inclusive Design Access for All Supplementary Planning Document (attached as Appendix 1 to the report) as an SPD for use as a material consideration in the development management process.

            (3) Authorises the Director of Planning and Transport and Director of Law and Democratic Services to make minor changes to the content of the SPD prior to publication in consultation with the Chair of the Local Development Plans Working Party as appropriate.

            (4) That the Director for Planning and Transport be authorised to publish the document on the Council’s website and make copies available for purchase.

Minutes:

The Director of Planning and Transport submitted a report seeking approval for officers to progress a Community Infrastructure Levy (CIL) Charging Schedule for Swindon Borough.  The CIL would become the principal means by which developer contributions towards infrastructure would be collected by Swindon Borough Council.

Resolved – (1) That the Director of Planning and Transport be authorised to progress a Community Infrastructure Levy Charging Schedule for Swindon Borough; and

            (2) Future reports be submitted to Cabinet and Full Council to agree a provisional Draft Charging Schedule for consultation, to report on the outcome of that consultation, to agree a resulting Draft Charging Schedule for consultation, and to keep Planning Committee informed of progress.
