Section 100B(4)(b), Local Government Act 1972

Minutes:

In accordance with Section 100B(4)(b) of the Local Government Act 1972, the Chair determined that an additional item concerning the proposed creation of Designated Public Places within the Borough, be considered as a matter of urgency to allow a recommendation to be made to Council on 17th January 2008.  (Minute 33 refers.)

Members are reminded that at the start of the meeting they should declare any known interests in any matter to be considered, and also during the meeting if it becomes apparent that they have an interest in the matters being discussed.

The Chair reminded Members of the need to declare any known interests in any matters to be considered at the meeting.  Councillor Brian Ford made a personal and non-prejudicial declaration of interest in respect of the urgent item (designated Public Places) as he is the Vice-Chair of the Wiltshire and Swindon Police Authority.

Setting of Additional Fee Levels in Relation to the Gambling Act 2005 pdf icon PDF 22 KB

Minutes:

            The Licensing Manager submitted a report setting out proposals for the setting of discretionary fee levels for the purposes of the Gambling Act 2005 (Temporary Use Notices) Regulations 2007.

            Resolved – That the fee for a Temporary Use Notice be set at £300 and the cost of a replacement of a Temporary Use Notice be set at £12.50.

Responses to proposed Designated Public Places (Alcohol Restriction) Scheme to cover public land at the Orbital Retail Park and The Broad Street Area

Minutes:

            The Committee considered (a) a report of the Council’s Licensing Manger setting out responses to consultations on the proposed implementation of new Designated Public Place Orders covering the land at the Northern Orbital Retail Park and in the Broad Street Area, Swindon, (b) letters received in support of the proposal from (i) Blusdon St. Andrew Parish Council, (ii) Pace Petroleum Limited, (ii) Michael Wills, M.P., and (iv) Anne Snelgrove, M.P., (c) a letter of objection to the proposal received from Haydon Wick Parish Council, (d) Minute 26 of the Licensing Committee,  (e) the report of the Licensing Manager on the proposed scheme considered by the Committee on 29th November 2007, and (f) further oral representations from Parish Councillor Phillip Eagle (Haydon Wick Parish Council).

            Resolved – (1) That, further to Minute 26, and subject to the confirmation of the Council, the Designated Public Place Orders covering the land at the Northern Orbital Retail Park and the Broad Street Area, Swindon, as shown on the map in the Licensing Manager’s original report to the meeting on 29th November 2007, (with the addition of the land between County Road and Ocotal Way, including Tesco’s and the former Wickes site), be approved.

            (2) That, further to Minute 26, the proposals for signage for the Designated Public Place Orders, as set out in the Licensing Manager’s original report, be approved.
